That's bad, and he should certainly be punished for it, especially because he was putting not only his life in danger but those of the cute elves and reindeer. But from this point on, Santa let's his constitutional rights dry up like last year's Christmas tree. 2. Santa answers questions. Rule #2 of asserting your rights during a police encounter is Don't Answer Questions. (Rule #1 is Don't Be Stupid, which Santa already broke.) You are under no obligation to answer questions, and don't think you are being rude by being quiet. By saying "It was just a little egg nog," Santa has all but admitted his guilt. If you feel you have to say something, say "Officer, I will not answer questions without my attorney. Is there some other way I can help you?" 3. Rule #3 is Don't Consent to Any Searches. Here Santa doesn't verbally consent, so the fact that the cops open his trunk without consent, probable cause, or a warrant would probably render their search unconstitutional, and therefore evidence could be suppressed in court, if Santa and his attorneys contest it. If Santa would have said "I do not consent to any searches" the cops would have had to take extra steps to open his trunk like proving probable cause or obtaining a warrant. 4. Santa really blows it when he becomes combative and runs. Rule #4 is Cooperate (Without Answering Questions Or Consenting To Searches). Running and cussing will just make things worse for Santa in the long run. And it doesn't help that he implicates the Easter Bunny, who can now be charged with conspiracy. 5. All this assumes that Santa has any constitutional rights in the first place. I'm pretty sure Santa is not a United States citizen. He's sure to get deported, so no gifts for the good kids this year. |
